Limitations of Liability and Warranty

SELLER WARRANTS THAT THE GOODS SOLD AND DELIVERED BY THE SELLER TO THE BUYER SHALL BE FREE FROM DEFECTS IN WORKMANSHIP AND MATERIAL UNDER NORMAL USE AND SERVICE FOR A PERIOD OF ONE (1) YEAR FROM THE DATE OF DELIVERY. Seller’s liability for breach of warranty shall arise only upon the return of the defective parts at the buyer's expense after notice to the seller of claimed breach and shall be limited to furnishing a like quantity of such goods free from such defects or, at the seller’s option to refund the purchase price. Notice to the seller of claimed defects discoverable by inspection must be given within ten (10) days after receipt of shipment. In no event shall the seller be liable to the buyer for indirect, incidental, collateral or consequential damages of any kind. The buyer indemnifies the seller, its successors and assigns from and against any and all losses, damages and expenses (including reasonable attorney’s fees) which the seller may sustain or incur as a result of any claim of negligence, breach of warranty or strict liability in tort in connection with the use of the goods furnished hereunder, except such as may be wholly caused by the negligence of the seller. In any case, the maximum liability of Hangatablet, LLC is limited to the purchase price of the good sold.

  • WARNING: The vehicle operator is solely responsible for operating the vehicle in a safe manner.
  • WARNING: An accident or collision resulting in damage to property, personal injury or death could occur if the operator of a GPS/Electronic equipped vehicle fails to pay full attention to travel conditions and vehicle operation while the vehicle is in motion.
  • WARNING: In an accident or collision the GPS/Electronic unit may come loose and act as a projectile, USE AT YOUR OWN RISK.

Payment Methods

Hangatablet.com accepts payments through PayPal, bank wire, or major credit cards. Other forms of payment must be prearranged with Hangatablet, LLC. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at the rate of 1.5% per month or the highest rate allowed by law, whichever is greater. Be aware, when you place an order through PayPal, you credit card will be charged in full due to the limitations of PayPal.

Shipping and Handling Charges

Your total cost for purchase of any product will include shipping and handling charges shown on the Hangatablet.com invoice.

International Orders

International orders may be subject to customs or import duties once the package reaches the destination country. Governing Law and Jurisdiction

Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Hangatablet, LLC and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of Florida, Miami-Dade County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Hangatablet, LLC that is more than one year after the date of the applicable invoice.

 

Severability:If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Florida law.

 

Waiver: The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

 

Entire Agreement: These terms and conditions, together with the Hangatablet, LLCs invoice respecting the products ordered by Customer, are the complete and exclusive agreement between Hangatablet, LLC and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Hangatablet, LLC and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Sales Tax

We do business throughout the United States and accordingly collect sales and use tax as required by applicable law. However, the law governing our obligation to collect sales tax from online purchases may change, and we may be required to collect sales tax from you without notice if there is a change in the law governing online sales.

Termination of Account

Hangatablet.com. may in its sole discretion terminate your account or your use of the Hangatablet.com Website at anytime. You are personally liable for any orders that you place or charges that you incur prior to termination.
